I. OWNERSHIP OF THE PORTAL

PARQUES REUNIDOS SERVICIOS CENTRALES, S.A. (hereinafter, "PARQUES REUNIDOS") with address at c/ Federico Mompou, 5, Parque Empresarial "Las Tablas", Building 1 – 3rd floor, 28050, Madrid, Spain and CIF A-84.885.441. Registered in the Commercial Registry of Madrid in Volume 23,506, Sheet 58, Page M-421,702, is the owner of the portal www.selwomarina.es (hereinafter, the "Portal") and makes it available to Internet users, in order to provide information about the products and offers of both PARQUES REUNIDOS and its subsidiaries (hereinafter, " PARQUES REUNIDOS GROUP”), as well as allowing the provision of different ticket purchase services and season passes through the Portal or any other type of product through the Portal as well as, where appropriate, making different contests available to users, games, surveys, etc.

For the above purposes, the identification and contact details of Leisure Parks, SA, a company that operates through the Portal and is the owner of the management of the Selwo Marina Park (hereinafter, the "Park") and, therefore, responsible for the sale of all products and/or services related to the Park, are the following:

II. GENERAL CONDITIONS OF CONTRACT

These General Conditions of Contract will expressly regulate the relations arising between PARQUES REUNIDOS GROUP and the Users who contract the provision of the services or products offered through the Portal.

These General Conditions of Contract have been prepared in accordance with the provisions of Law 34/2002, on services of the information society and electronic commerce, Law 7/1998, on General Conditions of Contract, Royal Decree 1906/1999, which regulates telephone or electronic contracting with general conditions in development of article 5.3 of Law 7/1998, Royal Legislative Decree 1/2007, of November 16, which approves the consolidated text of the General Law for the Defense of Consumers and Users and other complementary laws, Law 59/2003, of December 19, on electronic signatures and any applicable legal provisions.

This document is accessible at any time in the online purchase section of the PARQUES REUNIDOS´ Portal and can be printed and stored by the User.

1. INFORMATION PRIOR TO CONTRACTING

The purpose of these General Conditions of Contract is to regulate the general conditions for the provision of services offered by PARQUES REUNIDOS GROUP through www.selwomarina.es. The services that PARQUES REUNIDOS GROUP currently provides and that are the subject of the contract with the Users, the sale service of certain types of tickets and Season Passes for the leisure parks managed by PARQUES REUNIDOS GROUP, as well as, where appropriate, of other products offered through the Portal.

The products and services offered by PARQUES REUNIDOS GROUP may be contracted by any User residing in Spain or in another Member State of the European Union or the European Economic Area and by those Users who, residing in a State not belonging to the European Union or to the European Economic Area, Spanish legislation is applicable to them.

The PARQUES REUNIDOS GROUP ticket and Season Pass sales service, as well as any other products offered through the Portal, is onerous in nature, and the price of each ticket or Season Pass (including taxes) is determined in each moment in the Portal.

Access to the information contained in the Portal is not subject to any payment.

The User understands that the information contained in the Portal, the general information on the catalog of tickets and Season Passes, as well as the other products offered on the Portal and the General Conditions of Contract and perfection of the contract, are sufficient and sufficient for the exclusion of error in the formation of consent.

1.1 Procedures

To proceed with the use of the different purchase services offered on the Portal, the User must follow all the indications and instructions collected at each moment of the purchase process on the screen (PURCHASE), completing for this purpose the information required by the forms established in the Portal, which will imply the prior reading and acceptance of all the General Conditions of Contract established in the same, so that the User declares to know and accept said procedures as necessary to access the products and services offered in the section of PURCHASE of the Portal.

The User will formalize his/her purchase by complying with all the phases established in the PURCHASE section and sending it electronically. These General Conditions of Contract will become part of the contract with the User at the time of express acceptance by the User, manifested by completing and sending the purchase data entered in the PURCHASE section.

The use of any of the services of the Portal implies the acceptance as a User, without reservations of any kind, of each and every one of the General Conditions of Use of the Portal as well as the General Conditions of Contract and, where appropriate, of the Specific Terms and Conditions that, made available to the User prior to the formalization of their purchase, govern the acquisition of tickets or Season Passes as well as the acquisition of any other products and services offered through the Portal.

1.2 Documentation and Language

These General Conditions of Contract are accessible at any time in the online PURCHASE section of the PARQUES REUNIDOS Portal and can be printed and stored by the User.

In the case of the acquisition of tickets, once the purchase process is finished, the User will receive via email a purchase ticket (the "Ticket") with a barcode that will be the entrance to the leisure park. selected. Said Ticket may not be photocopied, manipulated or damaged as it would be canceled immediately.

This ticket is valid ONLY for the day indicated in the box marked as "Valid Date". Cannot be combined with other promotions or discounts. No exchanges or refunds are allowed. Each ticket has a unique barcode number that allows ONLY ONE ACCESS to the Park. Once validated, it cannot then be used again at a later date.

In the case of the acquisition of Season Passes or any other products and/or services offered through the Portal other than the acquisition of tickets, the User will also receive the Purchase Ticket by email. Likewise, in the Portal you will be informed of the Specific Terms and Conditions of the aforementioned products or services prior to contracting them.

With the issuance of the Ticket, all the requirements for making the substitute invoice document available are understood to have been fulfilled, in accordance with Royal Decree 1496/2003, of November 28, which approves the Regulations that regulate the obligations of billing.

Once the purchase process made available through the Portal has been completed and the corresponding Ticket has been obtained, no changes or returns will be accepted.

These General Conditions of Contract are written in Spanish.

1.3 Technical means

The Portal will make available to the User all the necessary technical means to identify and correct errors in the introduction of their data in the different forms that will appear on the screen during the purchase process.

1.4 Modification of the General Conditions of Contract

PARQUES REUNIDOS GROUP reserves the right to modify at any time these General Conditions of Contract or, as the case may be, the Specific Terms and Conditions, which may be applicable, as well as any other general or particular conditions, regulations of use or notices that result from app. The duty to notify Users shall be understood to be fulfilled by modifying the General Conditions displayed on the PARQUES REUNIDOS Portal.

In any case, before contracting products or services, you can always consult the General Conditions of Contract and, where appropriate, the Specific Terms and Conditions that are applicable. Likewise, it reserves the right to modify at any time the presentation, configuration and location of the Website, as well as the contents and the conditions required to use them.

III. SPECIFIC TERMS AND CONDITIONS

1. SPECIFIC TERMS AND CONDITIONS FOR "SPECIFIC DAY TICKETS" OR "OPEN DAY TICKETS"

  • Upon arrival at the park, it is essential that you validate your synchronized ticket in our APP, downloaded to your mobile or printed. Each ticket has a unique control barcode that allows a single access to the park and cannot be used again later. Manipulated tickets may prevent access to the park.
  • The ticket is valid only for the visit date selected in the purchase process and indicated in the "Validity date" field. Check the park's opening schedule on the website or mobile APP.
  • If the ticket has a special rate, such as a reduction for disability greater than 33%, member of a large family or others, the personal condition that entitles the application of the same must be accredited.
  • The purchase and use of this ticket entails the acceptance of the General Contracting Conditions of Selwo Marina (Leisure Parks, S.A.), which you can consult in this link; as well as the Operating Rules and specific conditions of admission that you can consult in this link.
  • As it is one of the exceptions to the right of withdrawal provided for in the regulations in art.103.l) of RD 1/2007, the ticket does not admit changes or refunds. Its sale to third parties is prohibited.
  • The ticket must be kept during the visit to the park and shown at the request of the employees.
  • Selwo Marina reserves the right to close the park or some of its facilities or cancel some of its activities without prior notice due to adverse weather, capacity, security, veterinary or public health reasons.

2. SPECIFIC TERMS AND CONDITIONS FOR THE PURCHASE OF COMBINED TICKETS

  • The purchase of combined tickets (or "SelwoPack") allows a visit to Selwo Aventura, Selwo Marina and Benalmádena Cablecar according to the choice made in the purchase process. The parks can be visited any day until the end of the season without the need for prior reservation, according to the opening calendar of each park, which can be consulted on its website.
  • The entrance to each park is valid only for the visit date indicated in the "Validity Date" field of the PDF ticket.
  • The purchase and use of this ticket entails the acceptance of the General Conditions of Contract of each park to which it gives access: Benalmádena Cablecar (Leisure Parks SA), which you can consult in this link; Selwo Marina (Leisure Parks SA), which you can consult in this link; and Selwo Aventura (Parque de la Naturaleza Selwo SL), which you can consult in this link; as well as the Operating Rules and specific admission conditions of each park: Benalmádena Cablecar (Leisure Parks SA), which you can consult in this link; Selwo Marina (Leisure Parks SA), which you can consult in this link; and Selwo Aventura (Parque de la Naturaleza Selwo SL), which you can consult in this link.
  • As it is one of the exceptions to the right of withdrawal provided for in the regulations in art.103.l) of RD 1/2007, the ticket does not admit changes or refunds. Its sale to third parties is prohibited.
  • Upon arrival at the park, it is essential that you validate your synchronized ticket in our APP, downloaded on your mobile or printed, directly at the entrance without having to go to the ticket office. Each ticket has a unique control barcode that allows a single access to the park and cannot be used again later. Manipulated tickets may prevent access to the park.
  • Selwo Marina, Benalmádena Cablecar and Selwo Aventura reserve the right to close the park or some of its facilities or cancel some of its activities without prior notice due to adverse weather, capacity, security, veterinary or public health reasons.
  • In Benalmádena Cablecar, from 21/07 to 31/08, the ascent from 20:00 requires the extra "Cablecar Nights", which includes the Open-air Planetarium activity at 21:45.

3. SPECIFIC TERMS AND CONDITIONS FOR "VIP EXPERIENCE" AND MANDATORY RULES FOR VISITORS PARTICIPATING IN THE ACTIVITY

Activity consisting of a small group tour through some of the areas of Selwo Marina, where you will access with the keepers to the habitats of some animals to interact with them and learn how to perform some of the daily tasks of the Conservation Department.

  • Without prejudice to the specific provisions established in these rules, the general “Operating Rules” of the park, published on the website https://www.selwomarina.es/en/legal/normas-de-funcionamiento, as well as the “Terms and Conditions” of purchase published on the website https://www.selwomarina.es/en/legal/terminos-y-condiciones, shall continue to apply, all of which you accept by checking the corresponding verification box during the online purchase process.
  • During the course of this activity, park photographers may take photographs and/or videos (without audio) with the aim of offering you the opportunity to purchase a souvenir of your participation at the end. This processing is based on the Park’s legitimate interest in accordance with data protection regulations. The images will not be used for promotional purposes nor retained beyond the end of the day on which the activity takes place, except for those that are purchased and include a QR code. In such cases, as part of the service, they will be stored for 90 days after the visit so that the customer can also download them in digital format. You may exercise your data protection rights (access, objection, deletion, etc.) by sending your request to dpo@grpr.com. Before participating in the activity, we kindly ask you to read the information sign located at the entrance of the activity or on the park’s website https://www.selwomarina.es/en/legal/captacion-de-imagenes, where you will find additional information about the processing of your personal data and the exercise of your rights. If you do not wish to be photographed or recorded, please inform the photographer and park staff before starting the activity and avoid posing proactively during the activity.
  • The minimum age to carry out this activity is 2 years. Children under 7 years of age must be accompanied by a paying adult (minimum 18 years), with a maximum of 2 children per adult. In such cases, the adult must purchase a ticket to participate in the activity along with the child(ren).
  • The activity reservation does not include the ticket park entrance, which must be purchased in order to participate in the activity. Children under 3 years old who are less than 1 meter tall are admitted to the park free of charge, but must reserve and pay for their spot to participate in this activity.
  • Participants in the activity will have to present themselves at Customer Service or the Park's Ticket Office at least half an hour (30') before the start of the activity. Once arrival has been confirmed, participants must arrive at the starting point of the activity at the indicated time. In the event of a delay on the part of the visitor at the start time of the activity, the tour will continue from the point of the planned route or where the activity is taking place at the time of joining, without any right to a refund or compensation of any kind.
  • Once the activity has been booked, no changes or refunds will be accepted, as it falls under one of the exceptions to the right of withdrawal provided for in article 103.l) of Royal Legislative Decree 1/2007. The booking must be kept during the activity and shown upon request by staff. Its sale to third parties is prohibited. If the booking has a special rate, the personal condition that entitles the application of the same must be accredited.
  • The reservation is valid only for the date and time selected in the purchase process and indicated in the "Valid date" field. It is essential to validate the activity reservation at Customer Service or the Park's Ticket Office by showing up at least half an hour (30') before the indicated time, showing the synchronized reservation in our APP, downloaded on your mobile or printed; or providing the locator obtained in the purchase process. Each reservation has a unique control code that allows a single use and cannot be used again later. Manipulated reservations may prevent the performance of the activity.
  • Throughout the activity, participants must follow the instructions of the Park staff at all times.
  • At no time may animals be touched without the keepers or staff permission. Likewise, situations that may endanger or disturb the animals must be avoided at all times.
  • Running, making sudden movements, or shouting during the activity is not permitted during the activity.
  • Participants are not allowed to take photos and/or videos during the activity.
  • Eating, drinking, smoking, or vaping is not permitted while the activity during the activity.
  • Participation is prohibited for anyone who appears to be under the influence of alcohol or drugs.
  • The use of a T-shirt or similar garment is mandatory, and the torso must be covered.
  • Due to the nature of the activity and the environment in which it takes place, visitors with mobility difficulties will not be able to participate. If in doubt, please consult us.
  • Park staff are authorized to remove from the activity any person who fails to comply with these rules or the Park’s “Operating Rules,” or who disobeys staff instructions, without any right to refund or compensation, and will be responsible for any consequences resulting from such behavior.
  • Selwo Marina reserves the right to close the park or any of its facilities or cancel any activities without prior notice due to adverse weather conditions, capacity limits, safety, veterinary, or public health reasons.
  • Selwo Marina will donate 5% of the price of this experience to the Parques Reunidos Foundation, helping to fund various wildlife conservation projects and supporting the mission to educate and promote best practices to protect animal life and ecosystems, inspiring love and respect for our planet’s biodiversity.

4. SPECIFIC TERMS AND CONDITIONS FOR "PENGUIN ENCOUNTER" AND MANDATORY RULES FOR VISITORS PARTICIPATING IN THE ACTIVITY

Activity consisting of a "Penguin Encounter" at Selwo Marina, which takes place inside its facilities.

  • Without prejudice to the specific provisions established in these rules, the general “Operating Rules” of the park, published on the website https://www.selwomarina.es/en/legal/normas-de-funcionamiento, as well as the “Terms and Conditions” of purchase published on the website https://www.selwomarina.es/en/legal/terminos-y-condiciones, shall continue to apply, all of which you accept by checking the corresponding verification box during the online purchase process.
  • During the course of this activity, park photographers may take photographs and/or videos (without audio) with the aim of offering you the opportunity to purchase a souvenir of your participation at the end. 5. SPECIFIC TERMS AND CONDITIONS FOR THE PURCHASE OF ONLINE MENUS

  • The online reservation of the menu entitles the user to enjoy the option chosen in the purchase process:
    • Adult Express Menu with a choice of hamburger or sandwich with chips and drink, or pizza with drink. Redeemable at La Colonial or Hamburguesería Las Delicias from 12:30 to 16:30.
    • Children Express Menu with a choice of children's burger or chicken nuggets with chips, drink and yogurtkids. Redeemable at La Colonial or Hamburguesería Las Delicias from 12:30 to 16:30.
    •  Hot Dog Menu with hot dog, chips and drink. Redeemable at La Colonial or Hamburguesería Las Delicias from 12:30 to 16:30.
    • Adult Self-service Menu: first course (choice of salad, pasta, cream or gazpacho) + roast chicken + drink + bread + dessert. Redeemable at La Colonial from 12:30 to 16:30.
    • Children Self-service Menu: pasta + second course (choice between escalope with potatoes or chicken nuggets with potatoes) + drink + bread + dessert. Redeemable at La Colonial from 12:30 to 16:30.
  • If for reasons unrelated to the Restoration Department, what is outlined cannot be offered, it will be replaced by a similar or superior product to the one offered.
  • Check the opening hours and location of each restaurant upon arrival at the park.
  • It is essential to validate the online reservation by showing the synchronized reservation in our APP, downloaded to your mobile or printed; or providing the numerical code locator obtained in the purchase process. Each reservation has a unique control barcode that allows a single validation and cannot be used again later. Manipulated reservations may prevent the enjoyment of the purchased menu.
  • The reservation does not include the entrance to the park, which is essential to acquire in order to access the park.
  • If the reservation has a special rate, the personal condition that entitles the application of the same must be accredited.
  • The purchase and use of this reserve entails the acceptance of the General Conditions of Contract as well as the operating rules and specific admission conditions of the park, which you can consult on our website.
  • As it is one of the exceptions to the right of withdrawal provided for in the regulations in art.103.l) of RD 1/2007, the reservation does not admit changes or refunds. Its sale to third parties is prohibited.
  • The reservation must be kept during the visit to the park and shown at the request of the employees.

6. SPECIFIC TERMS AND CONDITIONS FOR THE PURCHASE OF ALL INCLUSIVE: UNLIMITED FOOD AND DRINK

  • On the day of your visit, come to our information office at the Park entrance, where they will activate your All Inclusive bracelet (personal and non-transferable), linked to the purchase of a ticket, and they will inform you how to use it. With the All Inclusive bracelet you will have unlimited consumption of food and drinks (varied menus, salads and portions, Burger and Pizza, hot and cold drinks, pastries, ice cream, assorted bagged snacks, assorted tapas, sandwiches, etc.). Does not include cocktails with alcohol and spirits.
  • Maximum one drink per person every 30 minutes. Consumption is understood as restaurant menu, soft drink or beer and ice cream or coffee. If you have any questions, ask the restaurant staff.
  • It is essential to purchase at least one All Inclusive Adult to purchase an All Inclusive Child.
  • It is not allowed to deliver products (food or drink) to another person, if detected, the bracelet will be removed.
  • The bracelet is personal and non-transferable. In the event that the bracelet is damaged or lost, it will not be replaced.
  • The bracelet will only be valid on the day of the visit

These Specific Terms and Conditions may be modified at any time by PARQUES REUNIDOS and/or the management company of the Park. For more information consult in www.selwomarina.es.

IV. APPLICABLE LAW AND JURISDICTION

These General Conditions of Contract and Specific Terms and Conditions that are applicable will be governed by Spanish legislation, which will be applicable in what is not provided in this contract in terms of interpretation, validity and execution of the same.
