I. OWNERSHIP OF THE PORTAL

PARQUES REUNIDOS SERVICIOS CENTRALES, S.A. (hereinafter, "PARQUES REUNIDOS") with registered address at Federico Mompou, 5, Parque Empresarial “Las Tablas”, Edificio 1 - Planta 3ª, 28050, Madrid, Spain and Company Tax No. (CIF) A-84.885.441. Registered in the Madrid Companies Register in Volume 23.506, Folio 58, Sheet M-421.702 is the holder of the domain name www.selwomarina.es (hereinafter, the "Portal") and makes it available to Internet users, in order to provide information on the products and offers provided by PARQUES REUNIDOS and its subsidiaries (hereinafter, the "PARQUES REUNIDOS GROUP"), as well as to allow the provision of different services for purchasing tickets and season passes or any other type of products through the Portal and, where appropriate, to provide users with different competitions, games, surveys, etc.

For the above purposes, the identification and contact details of Leisure Parks, S.A., the company that operates via the Portal and is the managing owner of Selwo Marina Park (hereinafter, the "Park") and, therefore, responsible for the sale of all products and/or services related to the Park, are as follows:

II. GENERAL TERMS AND CONDITIONS OF BUSINESS

These General Terms and Conditions of Business shall expressly regulate the relationship between the PARQUES REUNIDOS GROUP and the Users who purchase the services or products offered through the Portal.

These General Terms and Conditions have been drawn up in accordance with the provisions in Law 34/2002 on Information Society Services and Electronic Commerce, in Law 7/1998 on General Contracting Conditions, in Royal Decree 1906/1999, which regulates telephone or electronic contracting with general conditions implementing Article 5.3 of Law 7/1998, in Royal Legislative Decree 1/2007 of 16 November, which approved the revised text of the General Law for the Defence of Consumers and Users and other complementary laws, in Law 59/2003 of 19 December on electronic signatures and any other legal provisions that may be applicable.

This document is accessible at all times in the online purchase section of the PARQUES REUNIDOS Portal and can be printed and stored by Users.

1. PRE-CONTRACT INFORMATION

These General Terms and Conditions are intended to govern the general conditions for providing the services offered by the PARQUES REUNIDOS GROUP through www.selwomarina.es. The services that the PARQUES REUNIDOS GROUP currently provides and which are the object of its contract with Users, the sale of certain types of tickets and Season Passes for the leisure parks managed by the PARQUES REUNIDOS GROUP as well as, where appropriate, other products offered through the Portal.

The products and services offered by the PARQUES REUNIDOS GROUP may be purchased by any Users residing in Spain or in another Member State of the European Union or the European Economic Area and by those Users who, residing in a State not belonging to the European Union or the European Economic Area, are subject to Spanish law.

The sale of tickets and Season Passes offered by the PARQUES REUNIDOS GROUP, as well as any other products offered through the Portal, is subject to a charge and the price of each ticket or Season Pass (including taxes) is specified at any given time on the Portal.

Access to the information contained in the Portal is not subject to any payment.

The User understands that the information contained in the Portal, the general information relating to the product catalogue, as well as the other products or services offered on the Portal and the General Terms and Conditions and completion of the contract, are adequate and sufficient for the exclusion of error in giving consent.

1.1 Procedures

In order to proceed with using the different purchasing services offered on the Portal, the User must follow all the indications and instructions given at each stage of the purchasing process on the (PURCHASE) screen, filling in the information required in the forms provided on the Portal, which implies the prior reading and acceptance of all the General Terms and Conditions of Business set out therein, such that the User confirms knowledge and acceptance of these procedures as being necessary to access the products and services offered in the PURCHASE section of the Portal.

The User will finalise their purchase by completing all the phases set out in the PURCHASE section and sending the information electronically. These General Terms and Conditions of Business will become part of the contract with the User upon express acceptance by them, evidenced by the completion and sending of the purchase data entered in the PURCHASE section.

The use of any of the Portal's services implies acceptance as a User, without reservations of any kind, of each and every one of the General Conditions of Use of the Portal as well as the General Terms and Conditions of Business and, where applicable, the Special Contract Conditions which are made available to the User prior to completion of their purchase and govern the purchase of tickets or Season Passes, as well as the purchase of any other products and services offered through the Portal.

1.2 Documentation and Language

These General Terms and Conditions are accessible at all times in the on-line section of the PARQUES REUNIDOS Portal and can be printed and stored by the User.

For the purchase of tickets, once the purchase process has been completed, the User will receive, via email, a receipt of purchase (the "Ticket") with a unique barcode which will constitute the admission ticket to the selected leisure park. This ticket may not be photocopied, altered or damaged as this will immediately render it invalid.

This ticket is valid ONLY for the day indicated in the box on the top marked "Valid Date", EXCEPT when purchased as a Flexi-Ticket, in which case it can be used on any chosen date (as long as that date is not a Friday, Saturday or Sunday marked orange on the calendar, meaning that Flexi-Tickets are not valid) or on one of the seven days following the chosen date, although it must be within the current season (Flexi-Ticket).

Cannot be combined with other promotions or discounts (including Flexi-Tickets). No exchanges or refunds are allowed (also for Flexi-Tickets).

Each ticket has a unique barcode number that allows ONLY ONE ACCESS to the Park (including Flexi-Tickets). Once validated, it cannot then be used again at a later date.

For Season Passes or any other products and/or services offered through the Portal other than the purchase of tickets, the User will also receive the Ticket purchased via email. Likewise, the Portal will inform you about any Special Contract Conditions for the aforementioned products or services prior to purchase.

Once the Ticket has been issued, all the requirements regarding provision of the document replacing the invoice are understood to have been met, in accordance with Royal Decree 1496/2003, of 28 November, which approved the Regulations governing invoicing requirements.

Once the purchase process provided through the Portal has been completed and the corresponding Ticket has been obtained, no changes or refunds will be allowed.

These General Terms and Conditions have been drafted in Spanish.

1.3 Technical Tools

The Portal will provide the User with all the technical tools necessary for identifying and correcting errors when entering their data in the different forms that will appear on the screen during the purchase process.

1.4 Modification of the General Terms and Conditions of Business

The PARQUES REUNIDOS GROUP reserves the right to modify these General Terms and Conditions at any time or, where applicable, the Special Contract Conditions, as well as any other general or specific conditions, regulations of use or notices that may be required. The duty to notify Users shall be understood to be fulfilled through the modification of the General Terms and Conditions displayed on the PARQUES REUNIDOS Portal.

In any case, the General Terms and Conditions of Business and, where applicable, the Special Contract Conditions that may be applicable, may always be consulted before purchasing products or services. Likewise, the Group reserves the right to modify the layout, configuration and location of the Website at any time, as well as the contents and the conditions required to use the same.

III. SPECIAL CONTRACT CONDITIONS

According to the current legal regulations published in the BOJA (Official Bulletin of the Andalusian Government), any user who accesses a catering establishment must present the QR code certifying that they are in possession of an EU Digital Covid Certificate.

1. SPECIAL CONDITIONS FOR PURCHASING TICKETS "SPECIFIC DAY TICKETS" OR "OPEN DAY TICKETS"

  • On arrival at the park, it is essential that you validate your ticket, whether uploaded to our APP, downloaded to your mobile phone or printed out. Each ticket has a unique barcode number that allows only one access to the park and cannot be used again at a later date. Tickets that have been tampered with may result in denied access to the park.
  • The ticket is valid only for the visit date selected during the purchase process and indicated in the "Valid Date" box. Check the park's open days in the calendar on the website or mobile app.
  • If the ticket has a special rate, such as a reduction for a disability of more than 33%, as a member of a large family or other, proof must be provided of entitlement to the special rate.
  • By purchasing and using tickets, you accept the General Terms and Conditions of Selwo Marina (Leisure Parks S.A.), which you can consult at this link; as well as the Operating Rules and Special Conditions of Admission which you can consult at this link.
  • As this is one of the exceptions to the right of withdrawal provided for in Art.103. .l) of Royal Decree 1/2007, the ticket does not allow changes or refunds. Reselling to third parties is prohibited.
  • The ticket must be retained during your visit to the park and shown to employees upon request.
  • Selwo Marina reserves the right to close the park or some of its facilities or cancel some of its activities without prior notice due to adverse weather, capacity, security, veterinary or public health reasons.

2. SPECIAL CONDITIONS FOR THE PURCHASE OF COMBINED TICKETS

  • The purchase of combined tickets (or "SelwoPack") allows a visit to Selwo Aventura, Selwo Marina and the Benalmadena Cable Car according to the choice made during the purchase process. The parks can be visited any day up to the end of the season without prior reservation depending on the open days of each park, which can be consulted on their website.
  • Each park ticket is valid only for the date of visit that is indicated in the "Valid Date" box on the PDF ticket.
  • The purchase and use of this ticket implies acceptance of the General Terms and Conditions of Business of each park to which it gives access: Benalmadena Cable Car (Leisure Parks S.A.) – available via this link; Selwo Marina (Leisure Parks S.A.) – available via this link; and Selwo Aventura (Parque de la Naturaleza Selwo S.L.) – available via this link; additionally, the Operating Rules and specific conditions for admission to each park: Benalmadena Cable Car (Leisure Parks S.A.) – available via this link; Selwo Marina (Leisure Parks S.A.) – available via this link; and Selwo Aventura (Parque de la Naturaleza Selwo S.L.) – available via this link; as well as the Operating Rules and Specific Conditions of Admission for each park: Reselling to third parties is prohibited.
  • On arrival at the park, it is essential that you validate your ticket, either uploaded to our APP, downloaded to your mobile phone or printed out, which you can do at the entrance without having to go to the ticket office. Each ticket has a unique barcode number that allows only one access to the park and cannot be used again at a later date. Tickets that have been tampered with may not allow access to the park.
  • Benalmádena Cable Car, Selwo Marina and Selwo Aventura reserve the right to close the park or some of its facilities or to cancel some of its activities without prior notice due to adverse weather, capacity, security, veterinary or public health reasons.

3. SPECIAL CONDITIONS FOR THE "DOLPHIN ENCOUNTER"

Activity consisting of a "Dolphin Encounter" at Selwo Marina in a facility that has been specially adapted for this encounter.

  • The activity reservation does not include admission to the park, therefore, it is essential that you purchase an entrance ticket in order to be able to take part in the activity. Children under 3 years old have free entry to the park, but must book and pay for their place in order to participate in this activity.
  • The minimum age for this activity is 2 years old. Children under 7 years of age or under 1.25 m tall must be accompanied by a paying adult (minimum 18 years). In such cases, the adult must purchase a ticket to attend the Encounter along with the minor. The activity not suitable for pregnant women. We recommend you bring a swimming costume for this activity and you can either take part in the activity wearing only this or with the wetsuit that we will provide on top; if you do not bring a swimming costume, a wading suit will need to be worn over your clothes. The trainers/monitors' instructions must be followed at all times.
  • Participants in the activity should be at the park ticket office one hour before the activity is due to start and in the VIP area at least 15 minutes before the scheduled time.
  • Punctuality is essential, as no access to the activity will be allowed from 5 minutes after the scheduled start time and there will be no right to a refund or compensation of any kind.
  • Temporarily, due to the current health situation and in order to protect the welfare of our animals, there will be no direct physical contact between visitors and animals during the interaction activities.
  • It is prohibited for anyone with any type of contagious disease that could be transmitted to the animals to enter and take part in the activity.
  • Taking part in the activity under the influence of alcohol and/or drugs is prohibited.
  • Due to the nature of the activity and the environment in which it is carried out, people with mobility difficulties are not able to take part. If in doubt, please contact us.
  • This activity is educational and fun, no animal therapy of any kind is carried out.
  • It is compulsory to disinfect feet and hands before entering the pool to take part in the activity.
  • Mobile phones, cameras and video cameras are strictly prohibited in the activity area.
  • You may not take part in the activity wearing glasses, rings, bracelets or other dangling objects.
  • You must not jump into the pool, make any sudden movements or shout while you are with the animals.
  • It is imperative that participants carefully follow the monitors' instructions at all times.
  • At no time may the animals be touched without the trainer's permission.
  • Smoking is prohibited.
  • Do not throw objects into the pool.
  • The keepers are empowered to expel any person who does not comply with the rules or who disobeys the keepers' instructions from the activity, with no right to any refund or compensation, as they are responsible for the consequences of any such behaviour.
  • The activity booking must be validated at the park's ticket office at least one hour before the indicated time, showing the ticket uploaded to our APP, downloaded on your mobile or printed, or by providing the numerical booking code supplied during the purchase process. Each booking has a unique barcode number that allows only one access to the activity and cannot be used again at a later date. Booking details that have been tampered with may result in you being unable to take part in the activity.
  • The reservation is only valid for the date and time selected during the purchase process and indicated in the "Valid Date" box.
  • If the reservation has a special rate, you must provide proof of the personal condition that entitles you to this special rate.
  • The purchase and use of this ticket implies acceptance of the online conditions of sale as well as the operating rules and specific conditions of admission to the park, which can be consulted on our website.
  • As this is one of the exceptions to the right of withdrawal provided for in Article 103.l) of Royal Decree 1/2007, the ticket cannot be exchanged or refunded. Reselling to third parties is prohibited.
  • The ticket must be retained during the visit to the park and shown to staff upon request.
  • Selwo Marina reserves the right to close the park or some of its facilities or cancel some of its activities without prior notice due to adverse weather, capacity, safety, veterinary or public health reasons.

4. SPECIAL CONDITIONS FOR THE "ENCOUNTER WITH PENGUINS"

Activity consisting of a "Penguin Encounter" at Selwo Marina, which takes place inside its facilities.

  • The minimum age for this activity is 2 years old. Children under 7 years of age must be accompanied by a paying adult (minimum 18 years), with a maximum of 2 children per adult. In such cases, the adult must purchase a ticket to attend the Penguin Encounter along with the minor. The activity not suitable for women who are or may be pregnant. The trainers/monitors' instructions must be followed at all times.
  • The activity reservation does not include admission to the park, therefore, it is essential that you purchase an entrance ticket in order to be able to take part in the activity. Children under 3 years old have free entry to the park, but must book and pay for their place in order to participate in this activity.
  • Participants in the activity should be at the park ticket office one hour before the activity is due to start and at Ice Island at least 15 minutes before the scheduled time.
  • The minimum height for mandatory wearing of impact protection goggles is 1.1 metres
  • At no time may the animals be touched without the trainer's permission.
  • You must not run, make any sudden movements or shout during the activity.
  • Mobile phones, cameras and video cameras are strictly prohibited in the activity area.
  • Taking part in the activity under the influence of alcohol and/or drugs is prohibited.
  • Due to the nature of the activity and the environment in which it is carried out, people with mobility difficulties are not able to take part. If in doubt, please contact us.
  • It is prohibited for anyone with any type of contagious disease that could be transmitted to the animals to enter and take part in the activity.
  • This activity is educational and fun. No animal therapy of any kind is carried out.
  • Participants must wear a T-shirt or similar type of clothing (which covers the torso)
  • The keepers are empowered to expel any person who does not comply with the rules or who disobeys the keepers' instructions from the activity, with no right to any refund or compensation, as they are responsible for the consequences of any such behaviour.
  • The use of the equipment provided for the activity (booties and disposable gloves) and fleece jacket is mandatory.
  • Punctuality is essential, as no access to the activity will be allowed from 5 minutes after the scheduled start time and there will be no right to a refund or compensation of any kind.
  • Once the activity has been booked, no exchanges or refunds will be allowed.
  • The activity booking must be validated at the park's ticket office at least one hour before the indicated time, showing the ticket uploaded to our APP, downloaded on your mobile or printed, or by providing the numerical booking code supplied during the purchase process. Each booking has a unique barcode number that allows only one access to the activity and cannot be used again at a later date. Activity consisting of a "Sea Lion Swim" in a facility that has been specifically designed for this activity.

  • The activity reservation does not include admission to the park, therefore, it is essential that you purchase an entrance ticket in order to be able to take part in the activity.

  • The minimum age for this activity is 4 years old. Participants must be able to swim. Children under 7 years of age must be accompanied by a paying adult (minimum 18 years). In such cases, the adult must purchase a ticket for the Sea Lion Swim along with the child. The activity not suitable for women who are or may be pregnant. For this activity, we recommend that you bring a swimming costume. The trainers/monitors' instructions must be followed at all times.
  • You should be at the park ticket office one hour before the activity is due to start and in the VIP area at least 15 minutes before the scheduled time.
  • Participants must wear a swimming costume or wetsuit with no external elements, such as fringes, laces or similar, protruding from the swimming costume or wetsuit.
  • Diving goggles are available for optional use. You may not take part in the activity wearing glasses, rings, bracelets or other dangling objects.
  • At no time may the animals be touched without the keeper's permission.
  • You must not run, make any sudden movements or shout during the activity.
  • Mobile phones, cameras and video cameras are strictly prohibited in the activity area.
  • The keepers' instructions must be followed at all times.
  • Taking part in the activity under the influence of alcohol and/or drugs is prohibited.
  • Due to the nature of the activity and the environment in which it is carried out, people with mobility difficulties are not able to take part. If in doubt, please contact us.

6. SPECIAL CONDITIONS FOR PHOTOS TAKEN DURING ANIMAL INTERACTION ACTIVITIES

By taking part in the animal interaction activities, the legal adult visitor acknowledges, accepts and authorises the following. For participants who are minors, the parent or guardian of the minor acknowledges, accepts and authorises on their behalf: 

  • That they are participating voluntarily in the Activity.
  • That they have been duly informed by the Park's organisers that certain photographs and/or videos will be taken during the Activity and that, as a consequence of this, their image and/or voice will be recorded, together with that of the other people taking part in the Activity. They hereby authorise the said capture of images and/or voice recordings for the purposes indicated below and, therefore, guarantee that they will indemnify LEISURE PARKS S.L. and Parques Reunidos Servicios Centrales, S.A. against any claim that may arise in this regard.
  • That, by voluntarily participating in the Interaction and by signing this authorisation, the participants assign to LEISURE PARKS S.L. and Parques Reunidos Servicios Centrales, S.A., free of charge, the image, voice and, if applicable, intellectual property rights over all images and/or voice recordings captured during the Activity (whether in photographic and/or video format) and, in particular, grant, exclusively and free of charge, the rights of public communication, reproduction, distribution and alteration so that LEISURE PARKS S.L. can proceed with the marketing and sale of the photographs and/or videos obtained during the Activity to the people taking part in it.
  • That their personal data, including photographs and/or videos containing their image and/or voice, will be processed by LEISURE PARKS S.L. (with address at c/ Federico Mompou, 5, Parque Empresarial "Las Tablas", Edificio 1 - Planta 3ª, 28050, Madrid, Spain) and its parent company Parques Reunidos Servicios Centrales, S. A. (with address at c/ Federico Mompou, 5, Parque Empresarial "Las Tablas", Edificio 1 - Planta 3ª, 28050, Madrid, Spain), as joint controllers (the "Controllers"). Their personal data will be processed exclusively so that they can obtain a souvenir of the Animal Interaction in which they have participated, by acquiring photographs and/or videos. By voluntarily participating in the Activity and by signing this authorisation, you authorise the processing of your data for this purpose.
  • To exercise the right of access, rectification and deletion of data, as well as to request that the processing of your personal data be limited, to refuse the processing, request the portability of your data or not to be subject to automated individual decisions, you are informed that you must send a written communication to the Parques Reunidos Data Protection Officer at the postal address: c/ Federico Mompou, 5, Parque Empresarial "Las Tablas", Edificio 1 - Planta 3ª, 28050, Madrid, Spain, or to the email address dpo@gpr.com, along with a copy of an official document proving your identity.
  • That the photographs/videos containing your image and/or voice recordings, and those of the other participants in the Activity, will be destroyed at the end of each day, and that it will be impossible to recover them. With regard to the rest of the personal data provided (name and surname, ID card number, signature, etc.), once the day has ended, they will be kept duly blocked by the Controllers, to be made available to competent Public Administrations, Judges and Courts during the period of limitation of the proceedings that may arise from the relationship maintained between the parties and/or the legally established periods of retention. After these time limits, all personal data will be deleted. Likewise, you are informed that you may contact the Data Protection Agency in those cases in which you consider it appropriate in order to safeguard your rights.

7. SPECIAL CONDITIONS FOR THE PURCHASE OF ONLINE MENUS.

  • The online purchase of a menu entitles the user to receive the option chosen during the purchase process:
    • "Fast Food" Menu: consisting of a hamburger or sandwich with chips and a drink, or pizza with a drink. Redeemable at La Colonial or Hamburguesería Las Delicias from 12:30 to 16:30.
    • "Hot Dog" Menu: consisting of a "hot dog" accompanied by chips and a drink. Redeemable at La Colonial or Hamburguesería Las Delicias from 12:30 to 16:30.
    • "Adult Self Service" Menu: consisting of a starter (choice of salad, pasta, soup or gazpacho), roast chicken, drink, bread and dessert. Redeemable at La Colonial from 12:30 to 16:30.
    • "Child's Self-Service" Menu: consisting of a first course of pasta of the day, main course choice of escalope with chips or nuggets with chips, drink, bread and dessert. Redeemable at La Colonial from 12:30 to 16:30.
  • If, for reasons beyond the control of the Catering Department, it is not possible to offer any of the above, it will be replaced by a similar or superior product to that described.
  • Consult the opening hours and location of each restaurant on your arrival at the park.
  • The online menu purchase must be validated by showing the ticket uploaded to our APP, downloaded on your mobile or printed, or by providing the numerical booking code supplied during the purchase process Each booking has a unique barcode number that allows only one use and cannot be used again at a later time. Purchase details that have been tampered with may result in you being unable to receive the desired menu.
  • The menu purchase does not include admission to the park, therefore, it is essential that you purchase an entrance ticket in order to be able to use it.
  • If the reservation has a special rate, you must provide proof of the personal condition that entitles you to this special rate.
  • The purchase and use of this ticket implies acceptance of the General Terms and Conditions of Business, as well as the operating rules and specific conditions of admission to the park, which can be consulted on our website.
  • As this is one of the exceptions to the right of withdrawal provided for in Article 103.l) of Royal Decree 1/2007, the ticket cannot be exchanged or refunded. Reselling to third parties is prohibited.
  • The ticket must be retained during your visit to the park and shown to staff on request.

7.1 ALL INCLUSIVE MENU

  • On the day of your visit, please go to our information office at the park entrance, where they will activate your All Inclusive wristband (personal and non-transferable), linked to the purchase of a ticket, and inform you how to use it. With the All Inclusive wristband, you can enjoy unlimited food and drink (varied menus, salads and dishes, Burgers and Pizza, hot and cold drinks, pastries, ice cream, bagged snacks, an assortment of tapas, sandwiches, etc.). It does not include alcoholic beverages or spirits.
  • Maximum one item per person every 30 minutes. An item is understood to include a set menu, soft drink or beer and ice-cream or coffee. If you have any questions, please consult the restaurant staff.
  • At least one Adult All Inclusive ticket must be purchased in order to purchase a Child's All Inclusive ticket.
  • Items (food and drink) may not be given to another person; if this is observed, the wristband will be confiscated.
  • Wristbands are personal and non-transferable. If a wristband is damaged or lost, it will not be replaced.                      
  • Wristbands will only be valid on the day of the visit.

IV. APPLICABLE LAW AND JURISDICTION

These General and Special Contract Conditions that apply shall be governed by Spanish law, which shall be applied in all matters not provided for in this contract regarding the interpretation, validity and execution of the same.
